Real people's faces and voices: notice, retention and release

For anyone depicted in a character and for whoever uploads their face or voice: what is collected, for how long, how it is destroyed, and the form to sign first.

1.Who this page is for

Draft2Cut lets studios build characters for video and animation. If a character uses the photograph or the voice of a real person, that person is entitled to know what happens to their data before it is collected, and to say yes in writing.

The person depicted does not use Draft2Cut: this page is what the studio uploading the material hands them. The studio has them read the notice and the retention policy below, has them sign the release form, and only then uploads the photo or voice. Draft2Cut collects consent on behalf of no one and cannot verify that it was given: it records the studio's declaration and refuses uploads until it exists.

2.What is collected, and why

  • Photographs and video frames of your face and body, and recordings of your voice, which the studio uploads as a reference for a character.
  • From this material the artificial intelligence services chosen by the studio may derive a representation of your face (its geometry) or of your voice, to draw the character, animate it, make it speak or sync its lips.
  • There is one purpose: producing the audiovisual work described in the release you sign. It is not used to identify you, to recognise you in other content, or to train Draft2Cut models.

The studio that uploads the material is its controller. Draft2Cut (Alcalambra S.r.l.) stores it and sends it on the studio's behalf to the AI providers the studio chooses, listed at /subprocessors. Application data and files are kept in the European Union; providers may process content outside the Union, as that page describes.

3.How long it is kept, and how it is destroyed

WhereRetention and destruction
On Draft2CutFor as long as the studio keeps the character. When the studio deletes the character, its files (photographs, turnarounds, expressions) are deleted from storage along with its record; when it deletes the project, all the project's files are deleted. When an organisation closes its account, its files are removed in a single operation after the notice period.
Project archives (backups)An archive holds the project's files and expires by itself on the date shown; it can also be deleted earlier by hand. Deleting a project deletes its archives too.
At AI providersAs each provider's terms say, which we do not control and have not all verified yet (see /subprocessors). We cannot guarantee destruction of copies held by them.
The consent recordIt stays after the files are deleted, as proof of what was accepted and when it ended, for as long as it is needed to establish or defend a right.

Biometric material must be destroyed when the purpose for which it was collected is satisfied, or within three years of your last interaction with the studio, whichever comes first. It is the studio that uploaded it that decides when, and deletes; Draft2Cut gives it the means and does not delete anything by itself after a number of years. If your release expires or you withdraw it, the studio must stop using the material and delete what it no longer has the right to keep.

If Draft2Cut discontinues the service, the biometric material it holds is destroyed at shutdown, and in any case within thirty days, after at least sixty days' notice to the studios that uploaded it, which can export what is theirs beforehand.

Draft2Cut does not sell, lease, trade or otherwise profit from biometric data. It discloses it only to the providers needed to produce the work, where the law requires, or with your consent.

4.Your rights

You may withdraw consent at any time by writing to the studio that had you sign the release; withdrawal applies going forward. You may ask for access, deletion and the other rights the law gives you from the studio and, for the processing we do on its behalf, at [email protected].

If you are under eighteen, the release must also be signed by whoever holds parental responsibility or guardianship. Without that signature the material is not to be uploaded.

5.For whoever uploads: how to use it

  • Before collecting or uploading any photo or recording, give this page to the person and have them sign the form below. Keep the signed original.
  • On the character's page, open the «Real person?» panel, declare that it depicts a real person and record the consent: name, scope of use, any expiry and, if you wish, the signed form.
  • If the release expires or is withdrawn, revoke the consent in the panel: uploads are blocked again. Then delete the character, or the files you no longer have the right to keep.
  • If the character is invented and depicts nobody, declare it fictional. A stylised or animated version of a recognisable person is not fictional.

6.Notice and release form

Form version: 2026-10-02. To be printed, filled in and signed before any collection.
