AI art: style or copy?
Episode 10 of 14 of our podcast on copyright and AI.
0:00 / 2:16
A palette, a brushstroke, a general aesthetic are a style, and a style is free for anyone to imitate. A specific character or a composition that copies a famous work is expression, and expression is protected.
A logo generated by AI usually has no copyright, but non-disclosure agreements, unfair competition law and above all trademark law can still protect it. Publishing contracts now need to say which parts of a work are AI-generated, because the publisher cannot have exclusivity on them.
