Deepfakes, voice clones and real people
Episode 12 of 14 of our podcast on copyright and AI.
0:00 / 1:50
When AI reproduces a real person's face or voice, copyright is no longer the question: privacy law and criminal law are. Italy punishes the harmful spread of deepfakes with up to five years in prison; under the GDPR a face or a voice is personal data, and biometric data when it is processed to identify the person.
In the United States, Illinois' BIPA lets people sue over the misuse of their biometric data and Tennessee's ELVIS Act protects a person's voice from unauthorised cloning. The SAG-AFTRA contract requires separate consent and payment for a digital replica of an actor.
